Court Declines to Issue Advisory Opinion as to What Actions State Must Take to Properly Preserve Documents for Potential Suit
Texas v. City of Frisco, 2008 WL 828055 (E.D. Tex. Mar. 27, 2008)
In this case, the State of Texas sought a declaratory judgment and the court's protection from a general litigation hold request, initiated by a letter sent by the City of Frisco. The letter asked the Texas Department of Transportation to generally preserve all electronic data associated with a particular highway toll project, and referred to potential litigation regarding the environmental evaluation of the toll project. The State speculated that the City would likely bring suit pursuant to the National Environmental Policy Act and the Admi...

Innocence Week @ NSU Law
NSU Law is marking Innocence Week in several ways. (If you're local, you've probably noticed the flyers featuring the 215 and counting exonerated around the Law Center.)
Last night, Alan Crotzer, who was wrongfully convicted and incarcerated for 24 years, 6 months, 13 days and four hours, addressed the NSU Law community. If you missed the event or want to read about it, check out the Miami Herald article. You can also catch an excerpt from Crotzer's talk at Local 10, where it was the lead story on last night's local news.
The Florida Senate is currently considering a bill that would provide Crotzer and ot...

Market Competition is the BestCase for Librarians
Connie Crosby has a good post up on the launch of Canada Law Book's new legal research offering BestCase. I say a 'good post' because Connie really echoes a lot of my own feelings about this new product.Despite some of the current critique, and you will remember similar comments arising when WEC produced a competitor product a few years back, Librarians are now faced with an increasingly fractured marketplace. And to be honest, I don't have a problem with that.[And before I get into this too far, full disclosure, Stem has done some work with CLB. ... Take it into consideration. I write this blog from experience, don't ...
